Gary Holmes, a 33-year-old Arkansas man is being charged with capital murder in connection to the shooting death of a 3-year-old boy during an apparent "road rage" incident in Little Rock. He was ordered held without bond today after surrendering to police last night following the issuance of a warrant for his arrest. He is being held by the Pulaski County sheriff’s office.
According to Holmes’ female companion, the accused became enraged when another vehicle followed his vehicle too closely. He then allowed the other car to pass him, according to an affidavit. Soon afterward, when the other car waited at a stop sign for a “few minutes”, Holmes sounded his horn, according to the girlfriend.
According to the account, Holmes then descended from his vehicle and fired a shot at the waiting vehicle and issued the taunt: “That’s what you ge for following me around.” They did not know that anyone was shot until reports emerged on the next day.
Another court date is set for Holmes on February 22. The sheriff’s office of Pulaski County has confirmed that Holmes is facing a capital murder charge, as well as two counts of terroristic acts.
Acen King was the three-year-old grandson of Kim King-Macon. The two were on a shopping trip together. The young boy’s death prompted the City of Little Rock and the FBI to offer a $40,000 reward for information leading to an arrest. According to Little Rock Police spokesman Lt. Steve McClanahan, Holmes was upset that King-Macon "wasn't moving fast enough at a stop sign." 
Police released a recording of a 911 call received from King-Macon who described the incident. "I was at the stop sign and the guy blew a horn at me and I blew it back, and he shot, but I thought it was in the air. He shot at the car!" It was not until King-Macon drove to a nearby department store where she realized that Acen was injured, finding him slumped over in the back of her car. 
"Acen has been shot, oh my God!" the frantic King-Macon cried in the 911 call. 
Acen was rushed to an area hospital where he succumbed to the gunshot. 
The accused, Holmes has an arrest record. He was detained for aggravated battery and robbery in 2002 and domestic battery in 2013.
